社区功能与社区矫正制度的完善

社区矫正是源于西方国家的一项司法制度,引入我国后,如果没有科学、合理的社区制度性功能定位,社区矫正将会失去其原有的品性,最终演变为社区的矫正。当前实践中的社区矫正制度种种困境产生的根源在于对社区功能的误解,其根本出路在于重塑一个具有共同利益和情感基础的、能对其成员进行教化的社区。

The Improvement of the Community Functions and the Community Correction System

Community Correction is a judicial system which originates from the west.If there is no scientific and suitable definition of community system function after being introduced into China,Community Correction will lose its original quality and develop into the correction of the community.The root of difficulties in practical community correction today lies in the misunderstanding of the communication function.The ultimate solution is to rebuild a community that has common interest and emotional foundation and is able to conduct education on all the members of that community.
