| 摘 要： | 严禁刑讯逼供的法律原则已深深地树立于各国的刑事诉讼法中,但是世界各国对刑讯逼供的认识不一,刑讯逼供的概念在我国也未取得一致,而且对于刑讯逼供的具体内容也有不同的理解,这就为司法实践中治理刑讯逼供问题带来了很大的困扰。文章从刑讯逼供的概念入手,探讨了刑讯逼供的内涵和外延,深入分析了刑讯逼供的本质,并提出了刑讯逼供概念的拓展型特质,希望对治理刑讯逼供有所裨益。
