社会管理创新法治化的基本问题研究

从词源学角度看,社会管理是一项重要的国家管理职能,其核心是公权力的运用,其根本目的在于公共利益。故而社会管理的核心是公权力的运用,当属于公法领域的问题,而进一步从权力的属性角度分析,社会管理实质上更多地属于行政权的运用问题,故社会管理及其创新应当接受法律的统制。换言之,必须坚守法治主义精神,应先通过法定程序对既有法律作出修改,尔后再行创新之举。

Some Basic Issues Regarding Legalization of Social Management Innovation

From the perspective of etymology., social management is an impo,tant national management functinn with the core of exercising public power and fundamental purpose fat＂ the public interest. Since its core lies in the exercise of public power, social management belongs to the domain of public law. By further analyzing power from the perspective of properties, social management substantially belongs to the exercise of executive power, so social management and innovation need to be legalized. In other words, we must adhere to the spirit of ode of law, revise current laws in accordance with statutory procedures and make innovations thereafter.
