| 摘 要： | 传统的罪过责任原则和相当因果关系论已经很难对环境污染犯罪的罪过和因果关系作出合理解释,应当确立环境污染犯罪的过错推定原则和因果关系推定原则,实行证明责任转换,由被告人承担部分举证责任。此外,对两项推定原则的具体运用应建立相应的法律机制。

| Abstract: | It is very difficult to explain reasonably the fault and causation of environmental crimes by traditional fault liability principle and causation theory. As a result it is essential to restructure the principles of fault deduction and causation deduction and attribute partial affirmative responsibility to the defendant. In addition, corresponding law system is bound to be found for the application of two deduction principles. |
