| 摘 要： | 诱惑侦查行为与传统侦查行为在行为的指向性、行为的目的性、行为的动作性及行为实施的形态方面存在着不同。不能简单地因为诱惑侦查具有这些独特的行为特征就否定其作为合法侦查行为的法律地位。相反，应通过弹性的法律规定对其作出更符合侦查实际的调控。

| Abstract: | There exist differences between tempting investigation and traditional investigation in objects,aims,actions and behavioral patterns.The legal status of the tempting investigation as a legal investigative conduct should not be denied because of its special characteristics.On the contrary,the tempting investigation should be controlled more practically through flexible legal regulations. |
