试论未成年人宪法上的基本权利

未成年人享有和行使宪法上规定的公民基本权利时 ,由于主客观等方面的原因 ,会受到一些特殊的限制。这些限制一般是以保护未成年人的权益和促成未成年人独立人格形成的名义而提出的 ,因而使得未成年人享有和行使的宪法上的基本权利具有了特殊性。然而未成年人宪法上基本权利的特殊性有可能造成对未成年人宪法上基本权利的不当制约甚至损害。因此 ,很有必要探讨对未成年人宪法上基本权利限制的合理性。

Minors' Basic Rights in Constitution

When enjoying and using their basic rights given by the constitution,minors may meet some particular limits because of subjective and objective reasons.These limits are generally put forward on the name of protecting minors' benefits and promoting their independent personality.However,this particularity may cause some improper restrictions and even dameges.So it is necessary to have a discussion on the reasonableness of these restrictions.
