透析无罪推定在我国的运用

无罪推定作为国际通行的刑事诉讼原则 ,被世界各国普遍采用 ,其原因就是其本身的科学性。无罪推定体现了一个国家法制民主文明化的程度。我国虽在 1996年刑诉讼中规定了无罪推定的一些精神 ,但并不到位 ,是相对的无罪推定。从保护公民合法权益与世界法制接轨的角度出发 ,我国在刑事诉讼立法中应大胆推行西方的无罪推定原则 ,以使我国刑事诉讼制度更趋完善。

Analysis on the Rule of Presumption of Innocence in Our Country

As an international criminal procedure principle, the rule of presumption of innocence is adopted by many countries of the world due to its scientific features. The rule reflects how well the democracy goes in a country. Though some spirits of the rule was stipulated in the 1996 Criminal Procedure Law in our nation, it is relative one. In terms of the protection of citizens legal interest and the connection with international legal system, the rule should be implemented widely in our legislation to improve the criminal procedure system.
