| 摘 要： | 诱惑侦查是指为了侦缉隐蔽且无被害人之犯罪 ,侦查以及协助侦查的有关人员 ,以实施某种行为有利可图为诱饵 ,暗示或诱使他人进行犯罪 ,待犯罪行为实施或结果发生后 ,拘捕被诱惑者的特殊侦查手段。我国刑事诉讼法要借鉴日、美等国关于诱惑侦查合法性问题的规定 ,在一定范围内有条件地承认诱惑侦查的合法性 ,使诱惑侦查这种有效的侦查措施在法律的范围内充分发挥打击犯罪的积极作用

| Abstract: | Seduction investigation is a special and effective way of criminal investigation with the purpose of detecting a hidden crime without a victim,which means that detectives and other related people of providing help to the detection bait a potential suspect on the purpose of making money or other benefit to carry out a crime,after the crime occured,the detectives immediately arrest seduced suspect.Chinese criminal procedure law shall draw the related stipularion from Japanese or American criminal procedure law,admit the legal state of the seduction investigation limited in a scope to put it into full effect of striking crime. |
