| 摘 要： | 新闻侵权是一种特殊的民事侵权行为,与一般民事侵权相比,它在构成要件和举证责任上均有其特殊性。由于新闻机构承担了新闻传播的宪法使命,所以在新闻侵权诉讼的司法实践中它应享有特殊的抗辩事由。
