| 摘 要： | 技术侦查从上世纪出现以来就在不少国家的刑事侦查中得到推广,而我国检察机关能否运用技术侦查手段应对职务犯罪的问题却长期备受争议.实际上,技术侦查以其独有的优势在打击犯罪方面成效显著,将其运用于职务犯罪侦查工作中具有必要性和正当性.2013年1月1日起,《中国人民共和国刑事诉讼法修正案》正式施行,职务犯罪技术侦查制度最终以基本法形式被确定下来,相关争论也从检察机关能否使用技术侦查转化为如何规范使用技术侦查.因此,我们必须对新形势下职务犯罪适用技术侦查的问题进行理性思考和研究.

| Abstract: | Technical investigation since its appearance in last 20th century has been promoted in criminal investigation in many countries around the world. However, there still exist disputes as to its application to post crimes in China. In fact, it is necessary and feasible to apply technical investigation with its special advantages in combating criminals to the investigation of post crimes. Based on the present situation of judicatory reform, we should perfect investigative ways in order to improve the investigative capability of post crime. This article analyzes the necessity and rationality of allying technical investigation to post crimes and reflects on the problem as to its application to the investigation of post crimes. |
