不能犯抽象危险说之坚持——兼与张明楷教授商榷

在我国,不能犯的危险性判断理论存在着修正的客观危险说与抽象危险说之争.修正的客观危险说对通说抽象危险说的批评绝大部分是没有道理的,其自身的理论建构也不成功.二者对峙的背后,实际上牵涉了不能犯处罚的根据应是结果危险性还是行为危险性,犯罪论的本质应是结果无价值论还是行为无价值论,理论研究方法应是演绎还是归纳等重大问题的争论.抽象危险说因与我国刑法规定及整个刑法理论相协调、认定标准简洁明快统一、符合我国的司法现实等优点而应当为我们所坚持.

Insistence on the Abstract Danger Theory of Impossibility——Discussion with Pro Zhang mingkai concurrently

There are the modified objective danger theory and the abstract danger theory in determining the danger of impossibility in our criminal law theory.However,most of the criticisms to the abstract danger theory is unfair,and the modifications of the objective danger theory are not successful.The arguments of the two theories in fact reflect many further discussions,such as whether the basis for punishing impossibility be the danger of result or act,whether the essence of the criminal theory be Erfolgsunwert or Handlungsunwert,whether the research method be deduce or induce.The abstract danger theory,coordinating with our criminal law and theory,having easy but integrated standards,and conforming to the judicial reality,should be insisted on.
