| 摘 要： | 关于无效合同是否有诉讼时效的问题,我国理论界和实务界之间对此争论不休,我国的合同法对此也没有相关规定,在司法实践过程中适用的标准也不一致。从现行合同法对无效合同的规定、确认无效合同应受诉讼时效期间的约束,以及无效合同诉讼时效的起算期间等几个方面对无效合同的诉讼时效问题进行分析,确认无效合同应受诉讼时效期间的约束。
