论不正当竞争行为的有效规制——以《反不正当竞争法》的修改为视角

《中华人民共和国反不正当竞争法》颁布距今已有20年的时间，却从未经过一次修订。这意味着该法中所界定的“不正当竞争行为”还停留在上个世纪的水平。而我国的市场经济从上世纪90年代初发展至今，在不断进步的同时，也催生了许多新形态的不正当竞争行为。对这些新形式不正当竞争行为的规制，《反不正当竞争法》已经显得提襟见肘。因此，对该法进行修改已经迫在眉睫。本文以《反不正当竞争法》现有的“一般条款”为切入点，阐述了对《反不正当竞争法》进行修改的设想，期望对该法的完善和不正当竞争行为的有效规制有所裨益。

On the Effective Regulation of Unfair Competition- In Perspective of the Revision of the Anti unfair Competition Law

The Anti - unfair Competition Law of the People＇ s Republice of China has never been revised since first issued for 20 years , which means the unfair competitive behaviors defined in the law still stay on the same level as last century. However, we have witnessed an increasing development of market economy in China, giving birth to the new forms of unfair competitive behaviors since the 90th of last century. Obviously, the Anti - unfair Competition Law nowadays is streched out to regulate these new forms of unfair competitive behaviors. Therefore, it is necessary to amend the Anti - unfair Competition Law. This essay explore the amendment of anti - unfair competition law from the perspective of its existing ＂general terms＂, hoping that it can be help to the perfection and well regulation of the law and corresponding behavior.
