义工行为侵权责任制度研究--以义工行为法律关系为基础

随着社会的快速变化,义工已经成为一种普通的社会现象,在这种情况下,法律应该有所作为.但是,从目前来看,义工不是一个十分明确的法律概念,义工行为当事人之间的关系也并不明晰.在我国的一些法律、法规或规范性文件、草案中,义工概念已经开始受到关注,因此,有必要对义工概念的内涵和外延进行研究.同时,应关注义工行为发生的侵权问题.而以义工行为的基础法律关系为出发点,进而探讨其侵权行为责任承担问题,不失为一条有益的路径.

On the System of Tortuous Liability of Volunteer's Behavior--Based on the legal relationship of volunteer's behavior

With the development of society, volunteer's behavior becomes more and more universal in the society, under the condition, the law should do something. However, at present, volunteer is not a specific legal conception, the relationship between the parties in the volunteer's behavior is not specific enough. And in law, legal text and document of law, the conception of volunteer receives more and more attention. Therefore, it is necessary to study the intension and extension of the conception of volunteer. Meanwhile, the problem of tort should draw more attention. It is a very good approach that we should start with the fundamental legal relationship of volunteer's behavior and then study the tortuous liability.
