论检察权性质的合理定位

关于检察权性质的研究,是近几年的热点。然而作为一个法律事实,我国检察机关定位于国家的法律监督机关,检察权定位于司法权,已得到宪法之确认;作为一个法学问题,检察权与检察机关的性质之争却一刻也未曾停歇。关于检察权的性质,我国学术界存在行政权说、司法权说、双重属性说和法律监督权说几种观点。我们应该结合实际来对我国的检察权性质作出合理定位。

The research of the nature of power of procuratorial.Is a focus in recent years.But as a juristic fact,the procuratorial organ of our country is orientated as the law supervising organ of the country,and power of procuratorial orientate as the judicial power,which have got the affirmation of the constitution.As a judicial question,and power of procuratorial and nature of procuratorial organ has never ended.About the orientation of power of procuratorate,our country's academia have different opinions administrative power,judicial power,double attribute mediate and legal authority on supervise and so on.We should make analysis to the nature of right of procuratorate of our country actually.
