| 摘 要： | 市民社会是黑格尔法哲学体系里的一个重要概念 ,并与政治国家形成一对范畴 ,从市民社会到政治国家的提升体现了伦理实体自由的理念。法律也由此在这个脉络上得以界定。黑格尔一方面肯定了市民社会中的法律对个体权利的张扬 ,另一方面也发现了其工具性的狭隘。因此在市民社会之上建构了政治国家的领域 ,从而赋予法律本身实质性的价值。简而言之 ,他给我们展示了一幅法律圆满生命力的图景。

| Abstract: | Civil society is an important concept in system of law philosophy of Hegel,and forms a pair of categories with the political country.The free theory of ethics entity is embodied from civil society promotion for the political country.The law can be defined on this train of thought too.Hegel has affirmed publicizing to individual right of law in civil society on one hand,on the other hand he has found that it is narrow of tool quality.So he has built and construct the field of the political country on civil society,thus entrust to the substantive value of the law. In briefly, he has shown the view of the satisfactory vitality of law to us. |
