| 摘 要： | 在我国现行抵押权法律制度框架下,建造中的船舶作为一种"未来物",与一般船舶的抵押在登记、客体、效力及实现等各方面都存在显著不同;并且,由于建造中的船舶很难变现,导致现行抵押制底对担保权人的利益保护不同,由此认为,在"未来物"上设立担保宜采用"让与担保"这一方式,其不仅有利于担保权的实现,而且有利于维护担保法在体系上的清晰和完整.

| Abstract: | In China, the mortgage of a ship under construction is different from the traditional mortgage of a ship, especially when it comes to registration, object, legal effect and realization. Because a ship under construction is a thing that will exist only in the future, so this mortgage, which is hard to be realized. Especially it isnt a traditional mortgage, therefore, in Chinese law a new-style of mortgage should be introduced and established. |
