侦查工作的效益与均衡理念

在刑事诉讼活动日益讲求效益的今天,为了提高诉讼效益,有效利用司法资源,在侦查机关的侦查理念中,应当树立效益观念,尽量地避免各种无谓的耗费。同时,在侦查机关的具体工作中,也应当杜绝那种效益至上的观念,力求达到实体正义与经济效益的平衡,达到犯罪惩治有效化与诉讼成本最小化之间的平衡。

The Effectiveness and Equilibrium Notion of Criminal Investigation

Nowdays,as the efficiency is increasingly stressed in criminal proceedings,in order to improve the effectiveness of the litigation and utilize the judicial resources, we should set up the concept of effectiveness in the notion of the investigative organization and try our best to avoid unnecessary expenditure. At the same time, we should exclude the idea that the effectiveness is supreme in the practice of the investigative organization, managing to attain the balance between the substantial justice and the economical effectiveness,and the equivalence between the validity of the criminal punishment and the minimization of the cost of lawsuit as well.
