| 摘 要： | 我国刑法理论中对单位犯罪双罚制的解释众说纷纭,并且相互矛盾。从刑罚目的论解释单位犯罪双罚制的依据,解决了这种理论基础上的矛盾,在同“罪责自负”原则价值趋同的基础上得出双罚制是“罪责自负”原则的例外,是在刑法理论原则和刑法目的实现的博弈中得出的权宜之计。
