我国首部行政程序法典实证分析

从行政程序立法的各种可能形式切入，借助两组变量建立政策形式矩阵模型，可以分析四种政策形式的理论内涵和实践情况，并据此得出其可行性序列。结合《规定》出台前的湖南省地方立法实践和《规定》立法时行政首长及政府成员的政策倾向，可分析《规定》采取地方政府规章这种政策形式的原因。根据《规定》的政策形式对其实施的影响，可看出从地方立法向全国立法的转换的重要意义。

Positive Analysis of China' s First Administrative Procedure Code

This thesis will start the discussion with various possible forms of administrative legislation. Here establishes a matrix of policy forms by use of two groups of variables, which analyzes the theoretical connotation and practical result of four policy forms. Thereafter comes up with a sequence of feasibility of the four forms. Secondly, analyzes the causes why the Administrative Procedures Regulation of Hunan Province adopted the form of local regulation through combined consideration of ante-Regulation legislative practice in Hunan Province and Hunan＇ s governor and government members ＇ policy inclination during the Regulation ＇ s enactment. Last, discusses the impact on the Regulation＇ s enforcement form its policy form and give some advices to the points.
