再论侦查监督制度:基于运行效果的反思与对策

实践中,侦查监督制度运行不力。从权力自主运行与权力配置的双重视角,主要原因在于侦查监督途径的事后性与书面性、制裁机制缺乏、目标考核机制不尽合理与侦查监督部门权力配置模式的内在冲突。以完善侦查监督制度为目标,首先应促进侦查监督权力模式配置的合理化,其次应改进侦查监督权力自主运行的结构体系。

Re-discussion on investigation supervision system: reconsideration and countermeasure based on operation effect

The investigation supervision system has limited function in practice. The main rea- sons can be ascribed to the after-thing and written form investigation supervision approach, lack of sanction system, rather unreasonable target-assessment system, and inner conflict of power colloca- tion mode in investigation supervision organs from the double viewpoints of free power operation and power collocation. Firstly, the rationalization of collocation mode of investigation supervision power should be promoted, and then the free operation structure system of investigation supervision power should be improved at the target of consummating the investigation supervision system.
