行政责任主体理论检讨

行政责任理论是行政法治建设的基石,但目前对其所进行的研究与其本身的重要性不成比例。虽然理论界与实务界对行政责任渐趋关注,但无论是传统的行政责任理论还是新近的行政责任学说,都尚存可质疑之处。循科学视角重构行政责任主体理论,建立以公务人员为责任承担主体的行政责任制度具有重大的理论与实践意义。

Review on Theory of Administrative Liability Subjects

The administrative liability theory constitutes the cornerstone of the ruling of administrative law.However,the current study is far from sufficient compared to its significance.Though increasing concern has been aroused in theory and practice,the traditional or late-developed theory of administrative liability still leave much space for doubt and enquiry.It is of great significance in theory and practice to reconstruct the administrative liability theory based on the public servants as the subjects from a scientific perspective.
