新道统法哲学立论基础应该为何——兼评魏敦友《当代中国法哲学的反思与建构》

当下中国处于转型期，法学／学术同样如此，不同思想此起彼伏，甚为壮观，新道统法哲学就属于此中的一环。新道统法哲学主要包道统思想的研究和传统社会秩序构成原理的研究。但当下的社会结构发生了剧烈的变化，以传统秩序构成原理作为新道统法哲学的理论基础是存在诸多疑问的，因此需要加以反思、批判和推进。

Theoretical Foundation for New Confucian Orthodoxy and Comment on Contemporary Chinese Legal Philosophy:Reflection and Reconstruction by Wei Dunyou

China is in the period of transformation,so are legal science and academic research.New ideas are emerging vigorously,among which is new Confucian orthodoxy.New Confucian orthodoxy consists of two areas,namely,thought study and the study of traditional social order composition principle.The social structure,however,has greatly changed.Therefore,the article holds that we need to reconsider and criticize the traditional idea of regarding the traditional social composition principle as the theoretical basis of new Confucian orthodoxy.
