| 摘 要： | 利用影响力受贿罪是《刑法修正案（七）》第十三条新增的一种犯罪，刑法学界对其构成要件中的诸多问题存在争议。对于犯罪主体中的近亲属、关系密切的人和离职的国家工作人员的范围如何界定以及犯罪客观行为中的利用职权和地位形成的便利条件、不正当利益作何解读等问题，都需要进一步予以探究。

| Abstract: | Crime of Influence Bribery is the new crime added by article 13 of Amendment 7 of Criminal Law,and there exists many disputed issues about its constitutive elements in field of criminal law.The problems such as how to define the scope of national staff leaving office,close relative,close persons in its main body,and how to interpret the abuse and status facilities,unfair interests in its objective behavior,needs to be further studied. |
