| 摘 要： | 犯罪是一种法律社会现象,因此,对之既可以进行规范分析即刑法学研究,也可以进行社会学分析即刑法社会学研究。立于既有的规范研究的基础之上,本文采用刑法社会学的视角,具体论析了社会发展进步与犯罪构成要件的敛缩问题。

| Abstract: | s:Crime is a kind of law and social phemomenon.So for the research of the criminal law,it is possible both to take the standard of the criminal law and it is the research of sociology of the criminal law.On the basis of analysis of law standard,this paper uses the analysis of sociol-ogy of criminal Law to expound the relation between the development and progress of society and restraint of constitutive elements of crimes. |
