亲权与监护立法之比较

目前,我国大陆地区正准备制定民法典,其中的亲属法编必不可少的要纳入进去。然而,面对亲权与监护有趋同的走势,如何使二者衔接起来,学界并无统一见解。但笔者以为,尽管亲权与监护具有趋同之走势,但从其各自的社会功能方面观察,仍有所不同,故亲权和监护分别立法,其内容设计上,应主要借鉴大陆法系国家亲属法,使二者真正地衔接起来。

Compare the Legislation of the Right of Kinsfolk with the Legislation of Ward

At present, the mainland of China is preparing for the constitution of civil code, and the law of kin will be one of the indispensable parts. However, confronting the trend of conformity between the right of kinsfolk and ward, how to make them dovetail, there is still no conform opinion in academic circles. By observing their respective social functions, the author concludes that the legislation of right of kinsfolk and ward should be separated and while designing them, the law of kinsfolk of the civil-law countries should be used for reference so as to make them really dovetail.
