劳动债权的研究评介及其理论前瞻

因应当下劳动者经济权益受侵害严重,劳动债权保护研究升温,目前主要围绕破产法中的劳动债权概念及其范围、清偿顺序、程序权利保护和破产法之外的工资与社会保险保护而展开,但由于研究不是从其债权本质属性的宏观视角出发,导致理论自身的自洽性问题和实践中的效果问题。故应当正本清源,对劳动债权的概念进行重构,对劳动债权再定性和定位,并在此基础上完善我国劳动债权法律保护体系。

Study and Evaluation on Labor Claims and Its Prospective Theory

Due to the serious violations of workers＇economic rights and interests,the study of labor claims is warming up. At present, the study mainly centers around the concept and range of labor claims in bankruptcy law, discharge sequence, the protection of procedure rights, wages and the protection of social insurance beyond bankruptcy law. However,the study does not base on the nature of creditors＇rights in a micro-vision,which leads to problems of its own self-consistency and of the effect in practice. We should re- construct the concept of labor claims radically and make a qualitative and oriental study of labor claims. On this basis,we＇ll improve and perfect the legal protection system of labor claims.
