社区矫正实施后的保外就医制度思考

《刑法修正案(八)》、《刑事诉讼法修正案》对社区矫正给予了法律上的肯定,标志着社区矫正制度正式上升到了法律层面。社区矫正既是一种有别于监狱行刑的社会化行刑方式,又是一种与监狱行刑相互承接、上下贯通的行刑制度,它为保外就医提供了制度性的监外承接载体,突破了传统监狱行刑难以向社会延伸的瓶颈制约,在社区矫正条件下,保外就医可以适当放低门槛,要配套相应的法律、制度,方能保证其顺利实施,彰显其人道主义光辉。

Considerations for the Medical Parole after the Implementation of Community Correction

Amendments to the Criminal Law （the eighth revision）, Amendments to Criminal Procedure Law give lawful affirmation to community correction, which shows that the institution of community correction has been lifted up to the legal level. Community correction is a social execution differing from prison execution,as well as an execution institution of connecting and linking with prison execution. Community correction provides an institutional supporting body outside prison under surveillance for medical parole, breaking through a bottleneck on limiting traditional prison execution to the social extension. Under the condition of the community correction, medical parole could be ensured to carried out smoothly and demon- strate its humanitarian glory by lowering the proper threshold, by supporting corresponding laws and institutions.
