恶意透支型信用卡诈骗罪之批判与重构

近年来，信用卡诈骗罪呈现多发态势，尤其是恶意透支型信用卡诈骗。虽然这只是个罪，但其影响已经超出个罪的范畴，且逐渐发展成为一个社会性问题。在刑事审判实践中，通过对恶意透支型信用卡诈骗罪主客观方面构成要件的解读，发现了这一个罪解读中存在的两个悖论。其主要原因是该罪的入罪门槛过低，刑罚权的干预范围过大，同时法律条文自身也存在一些问题。要修订该法条，可以借鉴德国立法模式，将恶意透支型信用卡诈骗行为从信用卡诈骗罪中剥离出来，独立成罪。

Criticism and Reconstruction of Credit Card Fraud of Malicious Overdraft

In recent years, there are more and more crime cases of credit card fraud, especially credit card fraud of ma[icious overdraft. It is only a type of a crime,but its impact is beyond itself,and it has grad ually developed into a social issue. In the practice of the criminal trial,we find the crime has two paradoxes by the analysis of the objective and subjective components of credit card fraud of malicious overdraft. The main reason lies in the too low incriminating threshold of the crime,the too big intervention range of the punishment power and the problems of the law articles by itself. In order to revise the law, we＇ll use the German legislation model for reference to peel the behavior of the credit card fraud of malicious overdraft off credit card fraud to be a separate crime.
