刑事错案预防与侦查能力的提升

当前刑事错案研究多立足于法院审判环节,而侦查语境下的研究意义尚未得到学界的足够重视。在"接近正义"之司法理念指引下,可以侦查为切入点重新梳理刑事错案的概念,明确刑事错案的判断标准及研究意义,并在此基础上建立刑事错案的长效预防机制:完善侦查措施,规范侦查行为,建立错案应对常态化机制,组建刑事错案审查机构,促进侦查能力的提升。

Research on Misjudged Criminal Cases and Improvement of Investigation Ability

The current criminal crime research more based on the court, and research significance in the context of investigation has not been paid enough attention by scholars. In＂close to justice＂under the guid- ance of the judicial idea,we use investigation as the breakthrough point to comb the concept of misjudged criminal cases, clarify the judgment standard and research significance of misjudged criminal cases, and on this basis, build a long-term prevention mechanism of misjudged criminal cases： perfect reconnaissance measures, regulating the investigation behavior, set up a normal mechanism to deal with misjudged criminal cases, build a criminal crime censorship,and promote the investigation level.
