犯罪学科学性视野下我国犯罪学若干认识误区之辨明——兼论关系犯罪学之提倡

我国犯罪学存在若干认识误区,在科学性方面有待加强。犯罪概念方面的误区表现在混淆了研究对象层面上的犯罪和概念层面上的犯罪,过于追求犯罪概念的精确化,忽视犯罪概念的心理学考察。研究方法方面的误区表现在认为犯罪是不可以量化的,量化就是有数据,忽视测量量具的标准化,认为犯罪研究是纯客观的。在犯罪学体系方面,传统犯罪学体系因其逻辑结构的大众化、通俗化和易滥用性不利于犯罪学往纵深方向发展。建立在关系哲学和实证分析基础上的关系犯罪学成为当今犯罪学体系的理想选择。

The Distinguishment of Several Misunderstandings of Criminology in the Scientific Perspective of Criminology --Also on the Advocation of Relationship Criminology

There are several errors in the understanding of criminology in China. The scientific of criminology should be strengthened. The confusion in the concept of crime lies in the difference between crime at the level of the object for study and the crime at the level of concept;over-emphasis on precision in the concept of crime and ignoring the psychological investigation on the concept of crime. In research methods, there are also many errors, for example ,the belief that crime can not be quantified;ignoring the standardi- zation of measurement gauge ~ thinking the study of crime is purely objective. On the side of system in crim- inology, traditional criminology system is not conducive to the depth of direction of criminology because its logical structure is popularized and easy to abuse. Relationship criminology, which is based on the relation- ship philosophy and empirical analysis is the ideal choice for criminology system.
