美日韩知识产权部门联合执法概况及其借鉴

知识产权部门联合执法是我国知识产权行政保护发展的最新趋势,具有力量集中、查处迅速、对侵犯知识产权侵权违法犯罪行为打击严厉的优势,但也存在知识产权各执法部门推诿扯皮、浪费执法资源、执法信息不能共享等问题.借鉴关日韩知识产权联合执法的做法,提出了建立高级别权威性知识产权部门联合执法协调机构、建立专业高效知识产权部门联合执法队伍、建立畅通快捷知识产权执法信息共享机制等对策建议.

Inspection and Inspiration of Law Enforcement Co-operation of Intellectual Property Departments in America/Japan/Korea

Joint law enforcement by intellectual property departments is the latest trend of our country’s administrative protection improvement of intellectual property,with such advantages as concentrated efforts,promptly investigation,and severe crackdown on crimes that infringe intellectual property rights.However,there are also such problems as buck-passing,resource waste,lack of information sharing etc.By drawing on the successful experiences of USA,Korea and Japan,we advise to establish high level authoritative coordination organization,build professional efficient team,build orderly fast information network,and rebuild solid,bounded agreement.
