浅析劳动者在劳务派遣中的法律地位及其保护

劳务派遣是企业的一种用工形式,在国外发展较为成熟,中国则稍晚。对于其法律性质,目前学界还存在争议。中国《劳动合同法》规定了劳务派遣制度,然较之于外国立法,仍存在需要完善之处。在考察各国劳务派遣立法的基础上,并结合中国司法实践,对中国劳务派遣的完善提出若干立法建议。

Analysis on the Legal Status and Benefit Protection of the Workers in the Labor Dispatch

Labor dispatch,which is a form of labor in the enterprise,develops very well in the foreign countries,but foremed later in our country.At present,there still exists dispute on the legal character of the labor dispatch.Labor dispatch is regulated in the Labor Contract Law in China.By contrast,labor dispatch in China still exists some defects.On the basis of the legislation on the labor dispatch in foreign countries,and the judicial practice of the labor dispatch,we put forward some legislative suggestion to perfect the system of labor dispatch.
