刑事诉讼模式新论

通过对刑事诉讼模式概念的梳理提出区分理论模型意义上刑事诉讼模式和社会存在意义上刑事诉讼模式的观点,认为理论模型意义上的刑事诉讼模式只是一种研究工具,更具方法论意义;社会存在意义的刑事诉讼模式因其文化特质不同而各有其精神与灵魂,我们面临的制度移植正是在这个意义上使诉讼模式与文化模式的结构找到了契合点。

A New View of the Criminal Procedure Model

In this article,through carding the concepts of the criminal procedure model,the author sets up a claim that criminal procedure model should be made a distinction between the theoretical Abstraction and the social existence.In the sense of methodology,the model of theoretical Abstraction is just a tool of research.On the other hand,as the specification,the models of social existence present diversified cultural styles.In the process of system transplantation,the conjunction of cultural structure and criminal procedure model have emerged.
