| 摘 要： | 刑事搜查是侦查人员依法对于犯罪嫌疑人以及可能隐藏罪犯或者罪证的人的身体、物品、住处和其他地方进行搜寻、检查的一种侦查行为。从启动、执行、终结程序分析我国现行搜查制度的不足，并提出重构设想。

| Abstract: | The criminal search is the action that the investigators search and inspect legally the suspects and person's body,the goods,the dwelling and other places which is possible to hide the criminal or the evidence.This article analyzes our country present search system's deficiency from the start,the execution,the terminator program three aspects,and pro-poses the corresponding reconstruct plan so as to perfect criminal legislation. |
