| 摘 要： | 破产撤销权制度是破产法上对债务人于破产程序开始前所实施的有害于债权人利益的行为予以撤销并将撤销利益返还破产财团的一种制度，它对于破产分配目标的实现以及破产预防程序的有效实施，都是必不可少的。本文试图从破产撤销权的构成要件谈起，并针对我国现行《企业破产法》的规定，对可撤销行为的范围做出梳理与评价，进而使破产撤销权在实践中得以有效适用。

| Abstract: | The system of avoiding power is used to set aside the actions which are harmful to the bankruptcy asset in the pre-bankruptcy period. It is necessary to achieve the aim of distributing property and defend business＇ s bank- rupting. This article talks about the constitutive requirements of avoiding power at first, hackle and estimate it as well. Furthermore, there are some amending suggestions at the end of this article. |
