| 摘 要： | 本文认为 ,沉默权首先应是一项宪法权利 ,诉讼法有关沉默权的规定 ,无非是宪法规定的具体化而已。确认沉默权制度体现了宪法保障人权的终极价值目标 ,是民主宪政制度发展的必然趋势。在宪法中公开确认沉默权 ,是符合现代民主政治要求的。

| Abstract: | The thesis holds the right to silence is primarily a right regulated in the constitution and the relevant to silence given by the procedural laws is just one of substantialized rights deriving from the constitution. Confirming the right to silence precipitates the ultimate goal of the constitution in safeguarding the human rights, and is a tendency to the democratic constitution. Public confirmation in the constitution embodies requirement of the democratic politics embodies the requirement of the democratic politics. |
