高技术战争有脱离现有战争法的可能,但不会完全摆脱战争法的调控,战争法将在高技术战争与现有战争法的矛盾斗争中谋求发展.因此,在我国的军事斗争准备中,必须克服战争法虚无主义和迷信战争法的思想,正确看待战争法的作用.在积极参与战争法创制的同时,还要认真进行军事准备.在战争中也要抓住有利时机,依据战争法展开政治上的揭露、军事上的报复、战争犯罪的国内惩治,争取战争的主动地位.
