治安指导概论

治安指导是行政指导的一种具体形式 ,是公安机关实现治安管理目的的一种非职权行为。其特征是 :主体具有特定性 ,性质具有行政性 ,方式具有多样性 ,内容是相对人的某种安全需要 ,以相对人的自愿为前提 ,治安指导行为不直接产生法律效果。其主要方式为 :警示、建议、发布警方消息。必要性、正当性和自愿性为其基本原则。公安机关实施治安指导行为必须符合的条件是 :对治安指导的事务具有法定的管辖权 ;不以相对人的同意为实施的前提条件 ;实施治安指导要符合程序正义的要求。
