完善离婚损害赔偿制度的几点思考

由中国人民大学民商事法律科学研究中心、最高人民法院、人民法院出版社共同主办、《判解研究》丛书编辑部和山东省济南市中级人民法院协办的第五届法官与学者对话论坛暨亲属法新问题与新展望研讨会于2008年9月在济南举行。本次论坛,将学者的理论创新与法官的实践经验相结合,围绕着"亲属法新问题与新展望"这一主题,就以下几个热点与难点问题进行深入探讨:夫妻共同财产的物权法规则适用问题;无效婚姻制度在适用中的疑难问题;《婚姻法》第46条在适用中的疑难问题;同性恋、准婚姻关系等法律适用问题。

On "the New Issues and the New Prospect of Family Law"

The 5th Dialogue Forum between Judges and Scholars and the Conference of New Issues and New Prospect of Family Law was held in Jinan in September 2008,which was co-sponsored by the Civil Business Law Science Research Center at People's University of China,the Supreme People's Court,and People's Court Press,assisted by Decisions Interpretations Series Editorial Office and the Intermediate People's Court in Jinan City,Shandong province.With the combination of scholars'theoretical innovation and judges'practical experience,this forum aimed to make furthur explorations and discussions about some heated and difficult issues under the title of"New Issues and New Prospects of Family Law",such as the rules application of community property in property law,the puzzling problem of invalid marriage system application,the application of Article 46 in Marriage Law,the legal application of homosexuality and pseudo-marriage relations,etc.
