摘    要:近几年,拖欠工资现象比较普遍,而拖欠民工工资问题尤为突出,已经演变成严重、复杂的社会问题。在我国,“恶意欠薪”行为缺少刑法保护。解开“恶意欠薪”这一死结,让所有的劳动者不再受其困扰,就必须在刑法中设立“恶意欠薪罪”。这不仅体现法律的公平原则,而且完全符合刑法的立法精神。

Abstract:It is common to see arrears of wage in recent years, and the arrears of wage of rural migrant workers are more serious, already becomes serious and complex social problem. On basis of clearly show the perniciousness and staff barkier. The author suggests that the law ought to criminalize "malicious back pay".
