| 摘 要： | 证据法学的理论基础应该具有特定性、多元性、层次性和开放性。理论界关于证据法学的理论基础还存在着较大的分歧。我国证据法学的理论基础是一个系统，它由辩正唯物主义认识论、利益均衡价值理论、诉讼模式和目的理论、证据心理学理论和科学技术理论等组成。
