| 摘 要： | 二手车交易中的确权问题对解决二手车买卖引起的纠纷十分必要.主要观点,一是二手车交易合同的有效性不能确定二手车物权变动生效;二是依据不动产登记确定不动产物权的有限性以及当前我国二手车市场发票制度的不完善,物权的意思表示可以作为确定二手车权利归属的补充.

| Abstract: | Right identying is very necessary in dispute settlement in secondhand car business.The main viewpoint:Firstly,the validity of secondhand car business contract can not necessarily lead to validity of the transform of right of secondhand car;Secondly,because of the limit of registration of real properity and faulti- ness of invoice system in the secondhand car market,the intention of right can make a complementarity to the i- dentification of secondhand car ownership. |
