| 摘 要： | 中国死刑既不能盲目从外 ,立即从立法上废止死刑或者在司法上弃死刑而不用 ,亦不能不顾世界舆论和趋势 ,一味重用和强化死刑 ,需要加速缩减死刑罪名 ,并在刑法修订中禁止增设新的死刑罪名 ;限制死刑适用的对象范围 ;调整死刑条件并予以严格规范 ;重新定位法定刑模式 ,力避重刑倾向 ;革新死刑核准机制 ,收归核准权力 ;大幅度减少死刑执行 ,以理性和人性代替感性和冲动。
