期待可能性之中国式解读

期待可能性是指在某种特定的情形下行为人客观上有无选择其他合法行为的可能性。从中国语境的角度，期待可能性理论体现中国传统的法律思想，契合中国构建和谐社会的发展主题，彰显中国刑法的人权保障机能。期待可能性理论注重对人性的关怀，对常理的考量，这种价值取向与我国刑法的基本精神如出一辙。我国刑法理论中虽无明确的“期待可能性”的范式表达，但在我国刑事立法及刑事司法中却体现了期待可能性理论的基本内涵。
