| Abstract: | The article observes that there exists a unity between instructive function and punitive function of the criminal law. The instructive function of the criminal law is shown through the punitive function, namely, punishing for the purpose of instructing. The nature of the criminal law requires just litigation procedure, the substantial content of the law demands juristic procedure. |
