试论西部开发过程中少数民族权益的保障问题

西部开发是中央和西部省区之间、汉族与少数民族之间以及各少数民族之间在经济方面的互助与合作.由于各民族之间在生产力发展水平上的差距和社会发展的不平衡,在开发过程中可能会碰到如下问题其一是资源开发与少数民族收益权由于上述差距而难以得到保障的问题;其二是环境的超载利用与少数民族可持续发展权益受到损害的问题;其三是土地征用过程中不能依法对少数民族群众进行补偿,从而损害少数民族应获得的土地补偿权益的问题;其四是在市场交易过程中,因少数民族群众(含个体或群体)所处的弱势地位,其交易平等权极易受到侵害并且难以得到救济的问题.这是在西部开发中必须切实关注并妥善解决的问题.

The Guarantee of Ethnic Legal Rights in the Large-scale Western Development

The large-scale western development means the economic cooperation between the Central government and the west regions of China, between the Han and other ethnic groups, and between different ethnic groups. However, disparities among different ethnic groups in production and social development will inevitably bring about problems. Difficulties in the guarantee of the ethnic legal rights will be evident because of: 1) the above-mentioned disparities; 2) overexploitation of the resources; 3) the inefficiency concerning the compensation for land expropriation; and 4) the uncertainty of equal rights for the ethnic people because of their weak position in trade. These problems must be solved properly in accordance with the law.
