| 摘 要： | 我国规定在《民法通则》和一些相关民事法律中的监护制度存在诸多缺陷。对其进行完善应该从以下几个方面进行：从立法上将亲权与监护分立；完善监护人的有关规定；扩大被监护人的范围；完善监护的内容；设立专门的监护监督人和监护监督机构。

| Abstract: | It has many flaws which the regulation in our country＇s guardianship are mainly represented in General Principls of the Civil Law and relevant civil legal regytations. Their Perfection should be the following areas： discrete the relative right and guardianship from legislation; perfect guardians＇ related regulations; enlarge range of person under guardianship; perfect guardianship content;set up special supervisor of guardianship and supervising mechanism of guardianship. |
