我国行政复议审理机构、审理人员、审理程序等存在诸多问题,制约了行政复议价值的实现。因此从公正角度看应设立统一独立的行政复议机构,确保行政复议工作人员的专业性、多样性和中立性,确立公开透明的行政复议审理程序;从效率角度出发应建立复议简易程序,明确行政复议调解和和解制度。

There exist many problems in our administrative reconsideration institutions,trial personnel and trial procedure,which restricted the realization of administrative reconsideration value.So from the perspective of justice a unified independent administrative reconsideration organization should be established,to ensure the professionalism,diversity and neutrality of administrative reconsideration staff.Open and transparent administrative recon-sideration of the trial procedure should be established;From the Angle of efficiency the summary procedure should be constructed,and a definite administrative reconsideration mediation and recon-ciliation system should be built.
