建立民事执行监督检察权运行机制探索

执行监督做为当前检察机关法律监督的改革创新和工作延伸,在我国对民事执行监督立法还不完善的今天,在实践中对法院执行难、执行乱起到了积极的制约和缓解作用。笔者结合近年来民事执行监督的探索和实践,就建立民事执行监督检察权运行机制谈谈粗浅认识,旨在加快立法进程,确保民事执行检察监督的正当性。

Exploration to the establishment of the supervision and prosecutorial power operating mechanism of the civil enforcement

The supervision of the enforcement as the reform and innovation and the extension of the legal supervision work of the procuratorial organs,when the supervision legislation is not perfect,has played an active constraint and mitigation in practice for the Court’s difficulty and chaos of enforcement implementation in China.The author combined the exploration and practice of the supervision of civil enforcement in recent years to talk about superficial understanding on the establishment of the supervision and prosecutorial power operating mechanism of the civil enforcement,in order to accelerate the legislative process to ensure the legitimacy of the supervision of the civil enforcement.
